Hitachi warns of legal action against trademark violators
Press Trust of India / New Delhi Jun 21, 2009, 14:33 IST

Diversified Japanese group Hitachi has warned of legal action against parties who violate the company's trademarks in India.

The company in a recent public notice said that without its consent, no party should be using any trademarks that are identical or similar with that of the firm.

Hitachi, which is operating in India as Hitachi India Trading, has significant presence in the country in different market segments including electronics, industrial components and equipment.

A spokesperson for Hitachi India said that it is only small manufacturers or traders who infringe the company's trademark.

"...It is only small manufacturers or traders that infringe our trademark and name. Most of such entities have stopped the infringement on issue of a warning letter from our lawyers since our trademark has been registered for around 60 years  and no company can legally use our trademark.

"In case the infringement is not stopped after we issue the warning letter we shall resort to legal options to fight," the spokesperson said.

The recent public notice said that Hitachi may even initiate civil or criminal action to enforce its copyrights.

According to the notice, all parties including manufacturers, service providers and sales companies have been asked to "immediately discontinue to infringe" on Hitachi's registered trademarks and trade names.

Meanwhile, the spokesperson said that in the past many years, the firm has found "small manufacturers or traders" infringing on its trademark and name.

"Through newspaper advertisements and legal action we were able to stop the infringement. However we need to keep advertising periodically and our lawyers also send warning letters to those parties who are infringing our trademark and name," the spokesperson noted.

Going by its website, Hitachi India Trading which markets and sells diverse products including power and Industrial Systems, industrial components & equipment, air conditioning & refrigeration equipment, among others.
