Notice to DLF over Vibes plea in land deal case
Press Trust of India / New Delhi Sep 29, 2009, 19:24 IST

The Delhi High Court has issued a notice to DLF on a plea filed by Vibes Developers challenging the order of the single judge that had favoured the reality major in a dispute over purchase of land on the Jaipur-Ajmer highway.

"Issue notice to respondent (DLF) to show cause as to why the appeal be not admitted," a division bench comprising Justice Mukul Mudgal and Justice Reva Khetrapal said, directing DLF to file its reply within four weeks.

Earlier in July, a single bench of the high court had directed Vibes to submit a bank guarantee of Rs 20 crore before the Registrar General.

DLF had moved the court alleging that Vibes had misused an advance payment of Rs 20 crore for purchase of 320 bighas of land on the Jaipur-Ajmer Highway.

The court said till next date of hearing, Vibes need not furnish a bank guarantee of Rs 20 crore favouring DLF.

"In the meanwhile, up to the next date of hearing, the operations of the impugned order shall remain stayed," the division bench said, adding the company court bench where DLF has filed a winding up plea against Vibes Developers will proceed in the particular case.

"It is made clear that the interim order will not come in the way of company court in dealing with the winding up petition filed by DLF or in passing any other order in that winding up petition," the court said, directing to list the matter in the the first week of October for next hearing.
