Prasar Bharati CEO moves apex court against CVC probe

Prasar Bharati CEO B S Lalli today moved the Supreme Court challenging the Delhi High Court interim ruling that ordered a CVC inquiry into alleged financial irregularities in Prasar Bharati Corporation (PBC) and appointed a former judge to supervise its board meetings.
A Supreme Court Bench headed by Justice B N Agarwal refused to stay the High Court's impugned order of July 27 and posted the matter for hearing on August 24.
According to senior counsel Soli Sorabjee, appearing for the CEO, this reflected from the petition, which stated that the powers of the PBC CEO should be shared with his junior officers -- Member (Finance) AK Jain and Member (Personnel) -- on the basis of a proposal prepared by Jain himself.
The petition concering sharing the CEO's powers and alleged irregularities was filed by the Centre of Public Interest Litigation in the Delhi High Court.
He said the High Court had erred in directing that the day-to-day functioning of PBC be carried out by the three members jointly and such direction was contrary to the Prasar Bharti Act, 1990.
It said that ordering the Central Vigilance Commission probe at this stage and passing all the directions when the matter is still pending in the High Court was like virtually allowing the petition.
