| The Supreme Court on Friday stayed further proceedings against MDMK leader Vaiko and eight of his partymen in the POTA cases against them in a designated court in Chennai.
| |
| Admitting a petition by the MDMK leaders challenging the Chennai court's order, Justices S N Variava and H K Seema also issued notices to the Tamil Nadu government.
| |
| Reacting to the news, Vaiko, who was in Coimbatore for a party conference, said the case was "going in the right direction".
| |
| He added that he had "full faith in the judicial system".
| |
| On September 3, the designated court in Chennai had rejected an application filed by the public prosecutor seeking to withdraw the POTA case against Vaiko and the other leaders.
| |
| The public prosecutor's application was filed after the Central POTA Review panel ruled that there was no prime facie evidence book the MDMK leaders under POTA for their speech in Madurai on June 29, 2002, allegedly in support the LTTE.
| |
| The designated court had denied permission to the Tamil Nadu government to withdraw the case against Vaiko and his partymen and had announced that the trial against them would continue.
| |
| The court said the state had 'prematurely' concluded the issue without having any opportunity to analyse the material relied upon by the prosecution, which was available to the court. |
