Satyam ex-company secy moves CLB over assets

The former company secretary Satyam Computer (now Mahindra Satyam) G Jayaraman today approached the Company Law Board (CLB) requesting it to lift the ban on selling

his personal property and assets.

Admitting the petition, CLB chairman Justice Raosaheb Deshmukh directed the government to file its reply within eight weeks, while Jayaraman has to file his rejoinder in two weeks. The next hearing is scheduled for April 7.

During the proceedings, government officials informed CLB that investigations into the Satyam fraud is in progress and that the Serious Fraud Investigation Office (SFIO) is still probing it.

Following the revelation of the Rs 7,800-crore fraud in Satyam in early January last year, the CLB had on January 23, 2009, frozen assets of five persons, including founder B Ramalinga Raju and company secretary Jayaraman.

Meanwhile, in another case, in which Mahindra Satyam sought CLB nod to hive off its Chennai-based animation division controlled by its BPO arm Nipuna, the board directed the company to file a proper affidavit regarding its assets.

The Mahindra Satyam counsel told the board that the animation division has no assets and also assured that there would be no manpower loss from the hive-off.

Earlier, the counsel informed CLB that the animation division has only 0.2 per cent contribution to the company's networth.

The board has listed the matter for next hearing on February 15.

Tech Mahindra, which acquired the Satyam last April, after the CLB's approval, has a lock-in period of two years for transferring or hiving off Satyam assets. However, if the transfer has been approved by the company board or shareholders, it can do so before that.
