Confectionery major Cadbury India has moved the Supreme Court against the Kerala High Court's refusal to quash criminal proceedings initiated against the company for alleged adulteration in its Dairy Milk brand chocolate.
The Supreme Court today issued notice to the Kerala government and other parties.
A Bench headed by Justice Dalveer Bhandari sought reply from the state government and others explaining why proceedings against the company should not be dropped.
Cadbuty India in its petition before the apex court said its plea against the criminal proceedings was not considered.
As much as 600 gm of Diary Milk chocolate were collected by authorities in October 2003 from a shop in Kerala and had sampled the same in three polythene packets.
The Public Analyst had found the sample adulterated as it contained uric acid to an extent of not less than 47 parts per million which is injurious to health.
The authorities had filed a criminal complaint before a trial court which framed charges against the company. The High Court had refused to stay the proceedings and asked the company and its officials to face the trial.
