Hilton Int'l protected from using trade mark 'Hilton'

Global hospitality chain Hilton International Corp has said it has been adequately protected from using the trade mark 'Hilton' for carrying on its business in India.

In a statement, Hilton clarified its special leave petition was dismissed on its consent and the Supreme Court noted that its concern was adequately protected by the Rajasthan High  Court.

"On going through the impugned order [of the high court], we find that the petitioners have been adequately protected by the high court. We, therefore, see no reason to interfere in the matter. The SLP is dismissed," the apex court said.

The statement said the SLP had sought a clarification from the apex court about the construction and impact of the high court order. It said that during the proceedings on July 11, Hilton suggested the apex court could dismiss the petition if it confirmed that that the high court order did not affect the hospitality major to continue with the popular trade mark.

Hilton International and a Rajasthan-based Hotel Hilltone are locked in a trade mark row.

Hilton International made its foray in India in 2007 in association with DLF.
