The Supreme Court today dismissed the appeal of the Uttar Pradesh government against the stay granted by the Allahabad High Court against the arrest of former Chief Minister Mulayam Singh Yadav and investigation against him.
Chief Minister Mayawati had slapped 148 corruption cases against Yadav after his Samajwadi Party released tapes allegedly damaging her reputation.
The Supreme Court also rejected the charge of bias against the Bench of the Allahabad High Court which had passed the order protecting Yadav. Senior counsel KTS Tulsi, representing the state government, alleged that while other accused were treated strictly according to the law, the high court Bench treated Yadav differently.
It violated the rulings of the Supreme Court while stopping investigation against him. The rule is that the high court should not stop investigation in a writ petition. However, in the case of Yadav, the high court was selective in granting the stay.
