Judges to be transferred after 3 years: Guj HC policy

A judge in the state would not be allowed to continue in one place for more than three years, as per the policy formulated by the Gujarat High Court.

According to a recent circular on ‘Policy and Modalities of Transfer and Posting of Judicial Officers’, transfers of judges in the state will henceforth take place only once a year, but no judge will be continued in a place for more than three years.

"A judicial officer will be allowed to continue at one place against one post or other post for about three years," the circular says. "Except in case of administrative exigency, a judicial officer may be transferred at any time from one post to another post or from one place to another."

The rule will apply to the judicial officers from magistrate to the district judge. A judge can seek posting at a particular place, but will have to inform the authorities two months in advance about the preference. Also, the new-comers will not get the benefit of this concession for the first posting. The High Court has created three zones, and transfers would take place between these zones.
