Under New York state law, 'adultery' is a class B misdemeanor, punishable with a fine of 325 pounds and up to 90 days of jail-time, the Daily Star reported.
Though friends of the couple deny that they started dating while she was with her husband Andrew Silverman, the 53-year old music mogul could be facing prison time for breaking this obscure law.
The 'Syco' boss is expecting a baby with Real Estate mogul, Andrew Silverman's wife, due in February 2014.
Andrew filed for divorce in New York, citing 'adultery' as the reason for the split, naming Cowell as correspondent, after their alleged affair was exposed.
