Intermediaries need to comply with Indian cyber law: Expert

Intermediaries and service providers in India need to be careful about their cyber law compliance, failing which they might face potential legal liabilities and reputational risks, a cyber security expert said on Thursday.

"As the Indian cyber law has now come up with various compliances for intermediaries, their non-compliance would not only expose them to reputational risks but also to potential legal liability," said leading cyber law expert Pavan Duggal at a conference here on intermediary liability of corporates under Indian cyber law.

Duggal highlighted the need for all entities qualifying as intermediaries to ensure compliance with Indian cyber law and adoption of proactive compliance culture by corporates.

"Given the changing digital realities of the day, the need for the government is to come up with more clarity on the parameters of due diligence, much beyond those as enshrined under the Information Technology Rules, 2011," Duggal noted.

He suggested that intermediaries should engage in specific compliance audits, given the increasing parameters of mandatory compliances under Indian cyber law.
