The settlement was announced by Berry's lawyer Blair Berk who held up a paper with a handwritten message to the press outside the court, reported Ace Showbiz.
"The parties have reached an amicable agreement. There will be no further statements regarding this matter," the note read.
The Bond girl of "Die Another Day" and her current fiance Martinez were not present during the announcement, but Aubry was there along with his attorney Shawn Holley.
The 37-year-old model hid his black bruised eyes under dark shades.
Aubry also won a restraining order against Martinez earlier this week, submitting graphic photographs of injuries including a black eye and cuts to his face alongside his court papers.
It was also reported that "Cloud Atlas" star Berry intended to seek a more permanent restraining order against Aubry.
