Los Angeles prosecutors declined to file any charges against the 77-year-old comedian because the case was too old and surpassed the statute of limitations, reported Los Angeles Times.
"Given that 40 years have passed since the alleged incident, prosecution... Is declined due to the expiration of the statue of limitations," the prosecutors said in a court document.
"Therefore, prosecution today for any potential felony sex crime from 1974 would also be barred."
According to the prosecutors, the statute of limitations at the time of the alleged incident was three years. They also said that the laws back then would only have made the crime a misdemeanour.
Cosby's lawyer Martin Singer later fired back to Judy's lawsuit, claiming she's lying and filed the lawsuit after failing to extort USD 250,000 from him.
