The Supreme Court today sought response from the Election Commission and Uttar Pradesh Police on a plea seeking a probe into non-filing of charge sheet in a case relating to alleged circulation of a controversial CD in Lucknow in 2007.
"Issue notice," a bench comprising Chief Justice H L Dattu and Justice A K Sikri, which had earlier provided legal assistance to the petitioner, a social activist, said.
It had asked Hans Raj Jain, who filed the PIL, to approach the Legal Services Authority on November 10 for getting assistance of a lawyer.
Jain has made Uttar Pradesh Police and the poll panel parties in the case and has sought a probe into non-filing of charge sheet against then BJP President Rajnath Singh, Lalji Tandon and others in the FIR lodged against them in Lucknow in 2007 for allegedly a circulating controversial compact disc (CD) there.
It was alleged in the FIR that the CD contained "inflammatory campaign material" against a particular community and till date no charge sheet has been filed by the UP Police.
The poll panel had then directed that FIR be lodged against all those responsible for producing the CD, including those who acted in it and written its script and those involved in its release, distribution and display.
