Authorities in Gurgaon have banned the use of JCBs or any other excavating machine along the DFCC alignment in villages falling under its jurisdiction.
Gurgaon District Magistrate Shekhar Vidyarthi has issued orders under Section 144 of Cr PC that no JCB machine or any other excavating machine will be admitted, parked or used along the DFCC alignment in villages Sohna, Raipur, Lakhuwas, Silani, Sancholi, Karanki, Khuntpuri and Ratikanaubad (Badkhera) in Sohna tehsil of Gurgaon district.
Indian Railways is constructing a double line track from Mumbai to Dadri exclusively to operate double container freight traffic. For laying this line, the Centre has created Dedicated Freight Corridor Corporation (DFCC) of India Ltd, a Government of India enterprise.
The land required for construction of this line is being acquired through a special Act named The Railway (Amendment) Act 2008. As per the Act, once 20 E notification is issued, the land vests with the Indian Railway, that is, the Centre.
Recently, in some villages in Sohna, unauthorised cutting or excavation of soil from the land falling in the DFCC alignment was noticed by DFCC field officials, which is highly objectionable and totally illegal activity.
Keeping these in mind, the District Magistrate has issued these orders to prohibit illegal excavation in the DFCC alignment.
However, relaxation has been given to public servants, police officers and any other persons deployed on government duty.
Anybody violating these orders shall be prosecuted under Section 188 of the IPC.
