HC bench orders custody of younger child to mother

: Madras High Court bench has directed that the younger son of a woman, her child by an earlier marriage, be handed over to her and the elder son be in the custody of her father
Justices Tamilvanan and V S Ravi, in their interim order on a haebeas corpus petition by the woman, seeking custody of her sons, said since she was also pregnant after the second marriage, she would get the custody of her four-year-old son, and her former husband, their 10 year-old son.
Both parents could meet their children at regular intervals, they ordered.
The petitioner submitted that she married Mohammed Ismail Galeel 10 years ago, who frequently demanded dowry and later sent her out of the house. He married another woman on August 28, 2013. When she went to meet him to seek custody of her two children, he refused and beat her up, she alleged.
She then lodged a complaint at an all woman police station at Tenkasi, seeking custody of her children as she feared her husband would be a threat to their lives. She said she had been badly hit by their separation and as their mother sought their custody.
The judges after hearing the petitioner, said her elder son would be sent with his father as he was more than seven years old and she could have the custody of the younger child.
