HC direction to Registry on PIL

The Madras High Court today directed the Court Registry to post before another division bench a PIL seeking to hand over the investigation of terror attacks, including the L K Advani pipe bomb case in Tamil Nadu, to the National Investigation Agency.
Listing the attacks and murders of leaders of Hindu organisations in the state, the petitioner, S.Subramaniam Balaji, an advocate, alleged the state police do not seem to understand the dimensions of national security and threats thereof.
The petitioner said NIA is the only investigation agency constituted by NIA Act, 2008 mandated to investigate matters concerning terror threats, counter-terrorism and security- related investigations.
The petitioner contended the terror activities of the group of Jihadi fundamentalists have culminated in furtherance of their common intention of eliminating leaders of Hindu outfits or whichever organisation is perceived to be pro-Hindu like BJP, Hindu Munnani and RSS thereby not only striving to create hatred among communities but also to destabilise the nation.
The petitioner said the terrorists are also said to have some hit list targeting the leaders and prayed transfer of the investigation of the murders and other terror activities to the Director, National Investigation Agency, New Delhi.
The pipe bomb case relates to planting of a pipe bomb on the yatra route of BJP leader L K Advani near Tirumangalam in Madurai district in 2011.
The High Court's first Bench, comprising Chief justice R.K.Agrawal and Justice M.Sathyanarayanan, directed the court Registry to post the PIL before a division bench.
