HC orders issue of notice to Registrar (Judicial) and DSP

Madurai bench of the Madras High Court today ordered issue of notice to the Registrar (Judicial) and DSP, Vigilance and Anti-Corruption, on a plea filed by former DMK minister N Suresh Rajan.
In his petition, the former Minister challenged the notice issued by the Registrar to the Chief Judicial Magistrate at Nagercoil on July 23 directing the CJM to summon him and his father in a disproportionate wealth case pending against them.
He said the the Vigilance and Anti-Corruption police had filed an interim petition in the District and Sessions court in 2012 seeking attachment of his properties pending disposal of the disproportionate assets case in the CJM court.
The Principal District judge ordered attachment of his property and he challenged it in the High Court bench which asked the judge to consider his plea to release his property from the custody of the Vigilance and Anti-Corruption.
Citing the notice of the Registrar, the CJM had summoned him and his father in the case. The petitioner said his father was a paralytic patient and could not attend the hearing. The single judge had not issued any direction to the CJM to summon the family members to the court.
The petitioner's case was against the interim petition filed by police. The Registrar had no jurisdiction to issue direction to the CJM and it was in violation of natural justice, the petitioner contended.
A Division Bench of Justice Jeyachandran and Justice M Venugopal ordered issue of notice and adjourned the case to October 10.
