HC orders Rs 10 lakh interim compensation in custodial death

The Kerala High Court today ordered the state government to pay Rs 10 lakh interim compensation to the mother of a man who died allegedly due to torture at a police station in Thiruvananthapuram in September 2005. Justice P D Rajan also ordered the government to recover the amount from the retirement benefits of the accused police officers if they were found guilty.
The Judge was dismissing a discharge petition filed by two of the accused.
During the hearing of the petition, the mother of the deceased submitted that the intention of the accused was to delay the trial in the case and said her family was suffering for the past 11 years after her son's death.
Following which, the Judge, citing a Supreme Court verdict, ordered the interim compensation.
CBI has registered two cases -- one relating to the alleged custodial torture of Udayakumar and another for alleged fabrication and forgery of police documents.
A total of 16 police personnel, including 4 DYSPs, have been chargesheeted in the cases and trial was on by clubbing both the cases.
