A bench of Justices Sanjiv Khanna and Chander Shekhar said that Narendra Singh Rao, former academic associate of Indian Institute of Mass Communication (IIMC), can raise the issue before the tribunal which has already scheduled the hearing on January 30.
The tribunal by its January 5 order had said that any fresh appointment made by IIMC shall be subject to the outcome of the application pending before it.
Advocates Arush Khanna and Paurush Kumar represented IIMC in the matter.
In his plea before the high court, he had sought setting aside of IIMC's December 21 order and a direction to the institute to forthwith reinstate him.
His plea had came up for hearing before CAT, which had issued notice to the institute but had refused to stay the order and restoration of services at this stage.
