Justice Manmohan also issued a notice to NDMC and the Centre seeking their responses within six weeks to Aam Admi Party (AAP) MLA's plea challenging a resolution passed by the civic agency withdrawing facilities provided to him.
"Actually it's (office) must. How can they function?. See you (legislature) cannot attend over 100 people, who come to meet you, at your house, for that you need a office," the court said, while directing NDMC "not to evict the MLA from his office".
The court has fixed the matter for further hearing on March 10, 2015.
The court's direction came on a plea moved by Singh, a Delhi legislative assembly MLA from Delhi Cantonment constituency, who has also challenged two letters issued by the Council on October 1 and 7 for vacation of his office.
The MLA has in his petition also sought quashing of the Council's resolution of September 26 as well as the letters.
In his plea, he has alleged that the withdrawal of his facilities, like office space, residential accommodation, car, chauffeur, etc, has been done with the aim to hamper him from performing his duties and functions as a NDMC member.
