The single bench of Justice H C Mishra granted bail for a period of two months after Kumar petitioned on the ground of taking his ailing son for treatment.
Kumar, who has been in judicial custody ever since he surrendered before a special CBI court on August 8, 2011 in connection with the scam, was former health secretary.
Former health minister Bhanu Pratap Sahi is also in judicial custody since August 6 last year on the same charges of purchasing alleged overrated medical apparatus, equipment and medicine worth Rs 130 crore and allegedly given to a favoured company.
