In November 2011, Gupta refused to marry the girl and when

she went to meet his parents, they too were not in favour of it. The girl then approached the police and lodged a complaint against him. Gupta was arrested on November 27, 2011. During the trial, Gupta said he was falsely implicated in the case by the girl and her family as she was having an affair with someone else and to save their honour, the family blamed him. He also said she was his cousin. Holding him guilty of raping the girl, the judge said the accused himself took the defence that she was his cousin and thus, he was aware that there was no possibility of their marriage. "He even then kept on assuring the girl to marry her and ultimately refused the same," the judge said.
