Rutherford could only muster, "I have no words..." before breaking down.
The actress has been embroiled in a custody battle with her ex husband, German businessman Daniel Giersch, for years now, ever since they split in December 2008, when the actress was pregnant with Helena.
Earlier in 2012, Rutherford wanted to keep the kids in the US, but a judge had ruled that it was in their "best interests" to live in Monaco with Giersch, who has been unable to enter the US since his visa was revoked that same year.
