Live in partner accused of rape acquitted

A man accused of rape by his live in partner has been acquitted by a district court.
The man was acquitted as the woman did not did not appear before court, which also felt that as she was a 27-year-old mature person living with the male partner with her consent, rape seemed unbelievable.
In 2014, the woman had lodged an FIR at the sector 20 police station stating that she was friends for six years with a man, who promised to marry her.
They started living together and one day the accused forcibly established sexual relations with her, the woman claimed.

The woman claimed she got pregnant twice and the accused gave her pills and got the pregnancy aborted. The third time she was not interested in abortion, the woman said in her submission.
She claimed that in October, 2014 she was admitted at a Noida hospital where her third pregnancy was aborted.

On her complaint, a FIR under IPC sections, 313, 493 and 376 was registered against the accused and the investigation officer got her medical examination done as per law.
The charge sheet was filed against accused who denied the charges.
Appearing as a witness, the owner of the rented accommodation in which they stayed, stated that accused and the woman lived there for 2 years and claimed to be husband and wife.

The medical report mentioned that the woman's age was 27 years. This shows that woman competent enough to understand the implications and the complainant woman did not appear before court inspite of repeated requests by investigation officer.
The court stated that the prosecution could not produce evidence which could hold the accused guilty.
The court of an additional sessions judge has acquitted the accused, said Chaman Prakash Sharma, District Government Counsel, (DGC), Crime, today.
