The 58-year-old actor pleaded no contest to one misdemeanour count of domestic violence involving his ex-girlfriend Oksana Grigorieva in 2011 and now his lawyer has filed documents, asking judge to remove the no-contest plea from his record, reported TMZ online.
Back in 2010, Grigorieva accused the actor of punching her in the face. Gibson, however, said that he only slapped her because she was shaking their daughter's body.
"I slapped Oksana one time with an open hand in an attempt to bring her back to reality. I did not slap her hard. I was just trying to shock her so that she would stop screaming, continuing shaking Lucia back and forth," he said.
Gibson has completed the order, including 16-hours of community service and 52 weeks of counselling. His probation ended in March. A hearing for the request is set to take place later this month.
Gibson was most recently seen sporting some beard while in a gym in late April. He next will take part in a movie called 'Blood Father' alongside Erin Moriarty.
