The seat fell vacant last year following the resignation of Mehbooba Mufti when she took over as Chief Minister of the state.
Justice Tashi Rabstan yesterday directed the Home Ministry to file its reply within two weeks to the petition filed by Ghulam Mohammad Wani, one of the contesting candidates.
Six candidates were in the fray for Anantnag Lok Sabha seat when the Election Commission (EC) rescinded the by-poll.
The EC had notified to hold by-election to the Anantnag seat on April-12 this year but had to postpone it by over a month due to widespread violence on the polling day in Srinagar Lok Sabha seat on April 9.
Wani approached the High Court earlier this year seeking directions to the Election Commission for holding the by-poll at the earliest.
The Anantnag Lok Sabha seat fell vacant last year in April after Mehbooba Mufti became the chief minister.
She later contested the Assembly elections from Anantnag assembly segment which fell vacant due to death of her father and then chief minister Mufti Mohammad Sayeed in January last year.
Wani, who was a candidate of All J&K Kissan Mazdoor Party, has challenged the inaction on part of the authorities to conduct the by-poll.
It claimed that respondents have failed to follow the procedure laid by the law on the point, the relevant section of the representation of peoples Act 1951.
