A real-estate broker, accused of raping a woman while helping her hunt a house on rent here, has been acquitted by a Delhi court after she turned hostile.
Additional Sessions Judge Virender Bhatt absolved the man, a resident of Najafgarh here, of the rape charge saying the complainant deposed "totally contrary to prosecution case".
"It is seen that the prosecutrix has deposed totally contrary to the prosecution case. Noting inculpatory against accused has come in her testimony. It is, therefore, beyond any shadow of doubt that the accused had never committed any sexual assault upon the prosecutrix," the judge said.
The court, while acquitting the woman, also noted she had deposed that she had not lodged any police complaint regarding rape but only harassment by the accused who was calling her up repeatedly to show her more houses on rent.
According to the prosecution, the woman had lodged a complaint alleging that she was looking for houses on rent and the accused, a broker, was showing her homes in Dwarka here.
On June 3, 2015, while they were at a flat, he made her consume a spiked drink after which she fell unconscious and he raped her, it said.
During the trial, the accused denied all the allegations levelled against him and claimed he was falsely implicated.
"Since the prosecutrix has not supported the case of the prosecution and there being no other eyewitness to the incident, it was found futile to carry on trial of the case any further... Resultantly, the accused is liable to be acquitted and is hereby acquitted," the court said.
