SC orders arrest of two for not vacating premises

The Supreme Court today ordered arrest of two persons for not vacating premises despite an order of the Bombay High Court saying they have made "all efforts to browbeat the process of law and to defeat the process of justice".
A bench headed by Justice J S Kehar, however, did not order arrest of an elderly woman and allowed her to remain out for handing over the possession of property to the respondent firm M/s Aditi Construction.
"In order to ensure compliance of the directions issued by the High Court, as of now, we consider it just and appropriate to direct the Deputy Commissioner of Police, New Delhi District, to detain petitioner no.2-Anirudh Kailash Sharma and petitioner no.3-Hemanda Kailash Sharma in civil prison, and produce them in the Court on November 5," the court said.
"We are satisfied that the petitioners have made all efforts to browbeat the process of law and to defeat the process of justice," it said, adding that the possession of one room with the petitioners has stalled the construction activity of the entire building since 2009.
The persons have not been vacating the premises in Mumbai despite court orders.
