The businessman Mahiveer Prashad Mansinghka and his son Virendra Kumar Mansinghka were sent to Bundi jail following the judgement.
Mahiveer Prashad Mansinghka owned an oil factory at Govindpur Bawdi in Bundi district.
Public Prosecutor Bhupendra Sahay Saxena said district sessions judge Ashok Kumar Vyas, while rejecting the appeal against the decision of the lower court, sentenced Mahiveer Prashad Mansinghka and Virendra Kumar Mansinghka, the managing director (MD) of the oil factory to one-year rigorous imprisonment.
The district judge also ordered a Rs 36,409 as compensation to local businessman Surendra Kumar Jain who had lodged a case of cheating against the father-son duo
The cheque was dishonored in the bank, following which a case was lodged against Mahaveer Prashad Mansinghka and Verendra Kumar Mansinghka under sections 406 (breach of trust) and 420 (cheating) of IPC at Talera police station in the year 2000.
The lower court in Bundi had sentenced the businessman to one-year imprisonment under section 420 and six months imprisonment under section 406 in July 2012, Public Prosecutor Saxena said.
The sessions court, however, today acquitted the father and son of the charge under section 406 of IPC but sentenced each of them to one year of rigorous imprisonment in jail under section 420.
