A city court hearing the Uber cab rape case today deferred the matter for April 16 after being informed by Delhi Police that the Supreme Court has continued the stay on the proceedings till further orders.
Special public prosecutor (SPP) Atul Shrivastava placed on record the March 24 order of apex court which had continued the stay on proceedings pending before the trial court till further orders.
Shrivastava told Additional Sessions Judge Kaveri Baweja that the appeal filed by the victim and police challenging the Delhi High Court's order allowing the accused to recall and re-examine 13 prosecution witnesses, including the woman, is scheduled to come up for hearing before apex court on April 8.
The court, after hearing the submissions of prosecutor, fixed the matter for April 16.
The proceedings of the case in the trial court were first stayed by the apex court on March 10.
On March 24, the apex court had also issued notice to accused Shiv Kumar Yadav seeking his response on the appeals.
According to the prosecution, the incident took place on the night of December 5 last year when the 25-year-old victim, a finance executive working in Gurgaon, was heading back home.
Police had said the woman had taken the taxi from Vasant Vihar to return to her house in Inderlok area of North Delhi and the accused, who took another route, allegedly raped her. Yadav was arrested on December 7, 2014 from Mathura.
In her statement recorded before the court earlier, the woman had identified Yadav as the one who had raped her.
The court has framed charges against Yadav under IPC for alleged offences of endangering a woman's life while raping her, abducting with an intent to compel her for marriage and criminally intimidating and causing hurt.
The court had also recorded the testimony of the accused in which he termed the charge against him as "false".
