Uber cab rape: Court yet to receive case file from SC

A Delhi court today could not hear final arguments in the Uber cab rape case, in which a woman was allegedly raped by the driver last year, as it has not yet received the case file and other records from the Supreme Court.
Additional Sessions Judge Kaveri Baweja fixed September 21 for hearing final arguments in the case on a day-to-day basis.
The court said it has neither received the case file, nor the apex court order setting aside the Delhi High Court order allowing the accused to recall and re-examine 13 prosecution witnesses, including the woman.
The apex court on September 10 vacated its stay on the trial court proceedings. The proceedings in the case were stayed by the apex court on March 10.
According to the prosecution, the incident took place on the night of December 5 last year when the 25-year-old victim, a finance executive working in Gurgaon, was heading back home.
Police had said the woman had taken the taxi from Vasant Vihar to return her house in Inderlok area of North Delhi and accused Shiv Kumar Yadav, who took another route, allegedly raped her. Yadav was arrested on December 7, 2014 from Mathura and is presently under judicial custody.
In her statement recorded before the court earlier, the woman had identified Yadav as the one who had raped her.
The court has framed charges against Yadav under IPC for alleged offences of endangering a woman's life while raping her, abducting with an intent to compel her for marriage and criminally intimidating and causing hurt.
The court had also recorded the testimony of the accused in which he termed the charge against him as "false".
