Veg vendor dies in road mishap, kin get Rs 9.8L compensation

Family members of a 35-year-old vegetable vendor, who died in a road accident after he was hit by a rashly driven truck, have been awarded over Rs nine lakh by a Motor Accident Claims Tribunal (MACT) here.
MACT Presiding Officer Manish Gupta directed National Insurance Company Ltd, insurer of the offending truck, to pay Rs 9,84,552 to the wife and three minor children of Jagan Lal, who died after being crushed by the vehicle while crossing a road in 2008.
While holding the driver of the truck guilty, the tribunal relied on the testimonies of Jagan's wife Sheela and an eyewitness Vinod, and documents including post mortem report of the victim and the FIR lodged in the matter.
"In view of above detailed facts and circumstances and evidence on record it is clear that the accident in question occurred due to negligence of the driver of the offending vehicle which was being driven in rash and negligent manner... which resulted in Jagan's death..." the tribunal said.
According to the petition, on January 26, 2008, Jagan was waiting with his vegetable cart to cross the road at a traffic signal in Rohini here when suddenly the truck, driven rashly and negligently, came from Madhuban Chowk side and hit him.
Due to the impact, Lal was crushed under the wheels of the vehicle and was declared brought dead at a nearby hospital, it said.
During the proceedings, the driver was proceeded ex-parte while the insurance company had filed a written statement contending that the driving licence of the truck driver was fake, but could not prove the allegation.
