MACT Presiding Officer Manish Gupta directed National Insurance Company Ltd, insurer of the offending truck, to pay Rs 9,84,552 to the wife and three minor children of Jagan Lal, who died after being crushed by the vehicle while crossing a road in 2008.
While holding the driver of the truck guilty, the tribunal relied on the testimonies of Jagan's wife Sheela and an eyewitness Vinod, and documents including post mortem report of the victim and the FIR lodged in the matter.
According to the petition, on January 26, 2008, Jagan was waiting with his vegetable cart to cross the road at a traffic signal in Rohini here when suddenly the truck, driven rashly and negligently, came from Madhuban Chowk side and hit him.
Due to the impact, Lal was crushed under the wheels of the vehicle and was declared brought dead at a nearby hospital, it said.
