Youth gets 7 yrs jail for killing relative

A youth has been sent to seven years in jail by a Delhi court for stabbing to death his relative in a fit of rage.
The court, however, diluted the murder charges framed against 24-year-old Sachin and convicted him for culpable homicide not amounting to murder saying it was not proved that he had intention to cause death of the victim.
District judge J R Aryan awarded the jail term to North East Delhi resident Sachin and refused to release him on probation saying he had assaulted the victim, father-in-law of his brother, with a knife which led to the man's death.
"Considering the young age of the accused, no previous involvement in any criminal incident and the circumstances in which the offence has been found committed, I award a sentence of seven years rigorous imprisonment with fine of Rs 5000 to the accused under section 304-II (culpable homicide not amounting to murder) of the IPC," the judge said.
According to the prosecution, Sachin had unintentionally killed Parmod Jha on July 5, 2011 by stabbing him on his leg with a knife resulting in his death.
Police said Jha's daughter married the brother of Sachin a few months ago and as she was not keeping well, her husband brought her to her parent's home.
On the day of the incident, Jha and his son Vikas had gone to Sachin's house to talk to his son-in-law about his daughter and during the discussion, the accused got infuriated and started abusing the victim and his family for getting their sick daughter married with his brother, it said.
Jha, 52, asked Sachin not to abuse them and went out of the house and this prompted the accused to bring a knife from inside and stab the victim in his leg, it said, adding Jha was taken to the hospital where he died.
During the trial, Sachin said Vikas had brought a knife with him when they had come to his house. Vikas had wanted to assault him but in that process, he stabbed his own father, he claimed.
