Youths get 3 years jail term for robbing man

Two youths have been sentenced to three years in jail by a Delhi court for injuring a man while robbing him off his valuables at his residence here.
Additional Sessions Judge Rajeev Bansal handed down the jail term to south Delhi residents, Amit Vishwakarma and Raju Dass, for robbing one Kishore Kumar off gold jewellery and two mobile phones after injuring him with a cricket bat.
"Both the convicts jointly robbed Kishore of his gold chain with locket, gold bangle and his two mobile phones after injuring him with a cricket bat. The valuables were recovered from both the convicts. Kishore received injuries at the hands of the convicts," the judge said, while convicting them.
While taking into consideration the family circumstances of Amit, who has a minor daughter and Raju, who has a younger sister too look after, the court awarded them a jail term of three years each for the offence of voluntarily causing hurt in committing robbery under section 394 of the IPC, which entails a maximum punishment of life imprisonment.
They were also convicted under section 411 (dishonestly receiving stolen property) of the IPC.
The court, while holding the youths guilty, relied on the testimony of the victim and also noted that Amit had admitted to the crime and had disclosed Raju's involvement in the offence too.
"Amit has clearly stated that not only Raju, but he himself was also involved in the commission of crime and they both gave beatings to Kishore and robbed him of his gold chain with locket, bangle and two mobile phones.
"Thus, the statement of Amit recorded is inculpatory in nature as he has not only attributed the offence to the co-accused Raju, but also owned responsibility of committing the offence," it said.
According to prosecution, Kishore had alleged that on November 26, 2010, two boys entered his house and committed robbery after hitting him with a cricket bat.
