The California Court of Appeal has dismissed all charges against Tata Consultancy Services by a non-profit group Californians for Population Stabilisation over deployment of Indian software professionals for project assignments in the US.
The court of appeal affirmed the trial courts earlier ruling that TCS has not committed any unlawful, unfair or fraudulent business practice, a TCS release said.
TCS executive vice-president (HRD) Joseph P Abraham said that CAPS had filed the case against TCS as well as Hewlett Packard (HP), which had assigned a project to TCS, in September 1993. He said CAPS, which strives for jobs for Americans, had alleged that HP gained unfair competitive advantage as TCS was paying lower salaries, paying no taxes to California and bringing in software professionals from India.
He said the court of appeal also ruled that the agreement entered into by software professionals with TCS was not unlawful.
