The Communist Party of India (Marxist) yesterday said the CBI should move the Supreme Court against Tuesdays Delhi High Court order quashing charges against BJP chief L K Advani and former Union minister V C Shukla in the Rs 65 crore Jain-hawala scam.

In a statement here, the party politburo said the judgement will have adverse repercussions in the prosecution of hawala cases.

Since some of the recipients have admitted to receiving payments either wholly or in part, the order will efectively nullify prosecution in the most serious case of corruption in high places which has come to light since independence, the statement said. It would have been better to leave it to the trial court to decide what is admissible evidence, the statement said.

The party said that it was necessary in the interest of justice and the fight against corruption that the CBI go in appeal to the Supreme Court against the judgement.
