Court gives anti-arrest shield to 'rape' accused

A Delhi Court Thursday granted anticipatory bail to a 50-year-old man who allegedly raped the wife of his nephew and threatened to make her obscene photographs public if she protested. The accused had denied the rape allegation.

Additional Sessions Judge Umed Singh Grewal granted anticipatory bail to Anil Kumar, accused of raping the victim in north Delhi, on a personal bond of Rs.30,000 and a surety of same amount.

The woman said in her police complaint that her husband was in jail when she was allegedly raped by Anil Kumar for the first time May 23. She alleged he gave her a cold drink laced with sedative and as she drank it she started feeling dizzy and after that he raped her.

The allegation was denied by Anil Kumar.

The court while granting anticipatory bail to Anil Kumar said: "The incident of rape is alleged to have taken place on May 23 and was repeated several times. The complainant did not report the matter to police or the court though she used to visit Rohini court regularly."

The judge noted: "Her husband came out of jail on June 4 but she preferred complaint only on July 6 and first information report was registered on July 15. This huge delay is indigestible."

The court took note of the submissions of the accused that he was implicated in the case at the behest of his nephew (the complainant's husband).

He told the court that the complaint of rape against him was a fallout of an extortion complaint lodged by him against the woman's husband.
