Tamil Nadu Satellite Broadcasters Association has moved the Madras High Court challenging the tender floated by Arasu Cable TV Corporation Limited for fixation of carriage fees for allotment of 23 slots of mid, super and hyper bands for telecasting free to air channels throughout the state except Chennai and Coimbatore.
When the petition challenging the February 9 tender came up for hearing today, Justice T.S. Sivagnanam issued notice to ACTV returnable by March 30.
The Association submitted that the tender had left out higher clarity bands such as prime band and S-band and the rationale behind leaving these bands have not been clarified in the tender.
It further alleged that by auctioning only 23 slots, ACTV has clearly shown discrimination towards pay channels and the free-to-air channels.
Hence, it prayed the Court to forbear the Corporation from removing or shifting the members of the petitioners Association from the slots/ bandwidths that are now being transmitted as they would be put to serious prejudice, irreparable loss and injury.
