The direction in this regard was issued by justice N K Balakrishnan on a petition by Joemon Puthenpurikkal, a social worker, complaining that despite the lapse of five years since filing of the chargesheet in the case, no action has been taken so far against the officials.
According to the petitioner, former Crime Branch SP, K T Michael, CBI SP Thyagarajan and former Kottayam Sub Divisional Magistrate S G K Kishore and others were involved in tampering the evidences in the case.
Initially, local police crime branch had stated that the nun had committed suicide. But a CBI probe later concluded that Abhaya was murdered but sought closure of the case due to lack of evidence. Courts refused to close the case and on November 19, 2008, two priests and a nun were arrested by CBI in connection with the case. On July 17, 2009, charges of murder and destruction of evidence were registered against them.
