Mahato, who was arrested on September 26, 2009 from Lalgarh area and had 18 cases registered against him under various sections of the IPC, would however remain in judicial custody as he still has one case pending under the Unlawful Activities Prevention Act (UAPA).
The former PCPA leader was accused of leading a mob and attacking and ransacking the house of Anuj Pandey in Dharampur, CPI(M)'s then Binpur-I zonal committee secretary on June 15, 2009. Pandey is one of the key accused in the Netai firing case and is currently absconding.
