The court had earlier ordered to police department to transfer the investigation into the case from Sulur Police Station Limits of Coimbatore District to City Crime Branch in the same district.
Justice P N Prakash gave the direction on a Criminal Original Petition filed by victim R Dharmalingam, who submitted that despite the order passed by the Court to transfer the probe from local police to Coimbatore CCB.
While rejecting the contention of the police that the orders have to be obtained from the DGP for the transfer of the probe, the judge said "tis court is unable to countenance this explanation. The Sulur Police Station lies within Coimbatore Rural Police District and the City Crime Branch Police lies within Coimbatore City Police District.
The matter relates to the alleged sale agreement made by Ramakutty Gounder, father of Dharmalingam in favour of N J Subramaniam on March 15, 2006.
After the death of Ramakutty, Subramaniam filed a suit for a specific performance against the legal heirs of Ramakutty.
Dharmalingama contended that the Sulur police did not investigate the matter properly following which he moved the court for transfer of the probe to CCB.
Despite the order of the court, police had not transferred the case following which Dharmalingam approach the court and te Judge ordered the transfer or the probe into the case to CBCID.
