HC dismisses petition of former UP planning commission member

The Allahabad high court today dismissed as "infructuous" a writ petition of a former member of the state planning commission challenging an FIR and seeking a stay on his arrest in a case of alleged firing and assault at Ahmadpur toll plaza in Barabanki district of Uttar Pradesh on June 8.
Iqbal, who had the rank of minister of state, is an accused and in jail after being arrested.
A division bench of Justices Arun Tandon and Anil Kumar passed the order on a writ petition filed by Iqbal, challenging the validity of FIR of the incident as well as seeking a stay on his arrest in connection with it.
On behalf of the state government, Additional Government Advocate Rajendra Kumar Dwivedi submitted that this writ petition has lost all its relevance in view of the fact that the petitioner has been arrested and sent to jail in judicial custody in connection with the case.
On June 17, the court had listed this matter for today and Iqbal was not arrested at that tiime.
"In view of the aforesaid statement, the present writ petition is dismissed as infructuous", the court said.
