Petitioner Kamatchi Periasamy alias Gokul of Karur district also sought transfer of the case from Karur Judicial Magistrate Court to Erode.
Justice T Sudanthiram asked the senior counsels of the Minister and his brother to take notice and posted the case for hearing on January 10.
The petitioner submitted that four persons including one Kozhi Balu, a close relative of the Minister, kidnapped him on June 3 last year and detained and assaulted him to force him to part with his property at the instance of Balaji and his brother. Later they had taken his signature on blank papers.
Police registered a case on his complaint only after a "prejudicial enquiry" and forwarded it to the Judicial magistrate.
He had also given a statement to the Magistrate under Sec164 of the CrPc, the Petitioner added.
