"You are more interested in lecturing the court on right to shelter (of slum dwellers) when the other party (MCD) is not disputing the right," a bench of justices Pradeep Nandrajog and V Kameswar Rao remarked.
The bench made the observation while hearing a petition filed by the NGO, Jhuggi Jhopri Ekta Manch, seeking rehabilitation of all dwellers of Arjun Das Camp adjacent to Kushak Nala in East Kidwai Nagar here.
The bench, however, noted that there was no data regarding the alleged dwellers left out of the survey or other necessary documents and the petition was full of jargon.
It granted liberty to the NGO to file a fresh petition.
"You just go on the Internet, type the word 'right to shelter' and get the judgements. Where are the documents in support of the people who you are saying have been illegally left out of the rehabilitation or the survey conducted by MCD.
The bench, in its order, observed that it had dismissed an earlier writ petition reserving the right to the petitioner to file a proper petition sans the jargon but containing factual averments relating and relevant to determination of issues.
