Justice Bala Krishna Narayana passed the order on a petition filed by Gandhi and also issued notice to Mohammed Sabir, who had filed an FIR against the MP and animal rights activist at Bisalpur police station in Pilibhit district on March 29, 2008.
Sabir had alleged in the FIR that supporters of Gandhi, acting at her behest, had snatched away cattle belonging to him while accusing him of "planning slaughter of cows on a large scale".
The police had also filed a charge-sheet in the court of Chief Judicial Magistrate Pilibhit on the basis of which criminal proceedings were initiated against Gandhi.
She had been a five-term MP from Pilibhit Lok Sabha constituency.
