In the photos, the 39-year-old German beauty is seen vacationing with her new boyfriend, bodyguard Martin Kirsten, with her bikini top off, reported TMZ.
Sources close to the former Victoria's Secret model said that Klum's camp is trying to locate the original French publication that ran the photos, since multiple websites have already picked them up.
According to the sources, Klum is upset because the photos were a blatant invasion of privacy, not unlike Middleton's case, in which she was snapped in a "healthy and profoundly intimate" moment at a villa in southern France, as Middleton's lawyer Aurelien Hamelle argued.
The Duchess of Cambridge has won an injunction against the French magazine for running the topless photos of her.
