The court took strong note that its direction to the jail super to take accused Anil Kothari, arrested in connection with a narcotics case, to the All India Institute of Medical Sciences (AIIMS) for a urology problem, was not complied with.
It directed superintendent and Senior Medical Officer to appear before it along with Kothari's medical records.
"The Superintendent, Central Jail no. 3 has perhaps failed to appreciate the direction given by the Court. The purpose of calling the medical record was to understand the ailment of the accused Anil Kothari and the treatment being given to him. Without the presence of the concerned Doctor, it is not possible to understand the medical record," Additional Sessions Judge Ajay Kumar Kuhar said.
"The undertrial prisoner has a right to be provided all the necessary medical assistance, as per requirement and, if the concerned Doctor and Superintendent, Central Jail fail to provide necessary treatment then it casts reflection on their functioning," the court said.
It summoned doctor Ajay Kumar, SMO and Superintendent, Central Jail, Tihar to appear in person on the next date of hearing on September 10.
The court also directed that the medical records should be brought to the court in person by the two officials and not sent through post.
