Dissatisfied with the manner in which an inspector carried out investigation in a case of kidnapping of a minor girl and closed it as 'false', the Madras High Court today directed him to reopen the probe.
"We are not satisfied with the status report filed by the Inspector of Police who is present before us wherein he has stated that he has closed the case as false; whereas the fact remains that even according to his investigation, the offence of kidnapping has been committed, but the kidnapper is not the person against whom the petitioner had suspicion," a division bench comprising justices M Jaichandren and S Nagamuthu said.
The bench was hearing a Habeas Corpus petition filed by the girl's father yesterday.
The court directed the inspector to re-open the investigation and take expeditious steps to secure the minor girl and produce her before the court on March 11.
It pulled up the inspector for closing the case as false when the offence of kidnapping was committed and only the accused was different, as per his own investigation.
The father submitted that his daughter, a 11th standard student in a government school at Karadichithur village, had gone missing on November 29, 2015.
The petitioner, a construction worker, alleged that it had come to his knowledge that his 15-year-old daughter had met a married man from Coimbatore on several occasions.
On that particular day, he was told that his daughter had taken leave and was at home as she was not feeling well. But at 10 AM the same day, she was missing and a search by the family did not yield any result.
Though he filed a complaint with police, they had closed the case, stating that the person whom he suspected was not the kidnapper and it was another person.
The court directed the Inspector to re-open the investigation and take expeditious steps to secure the minor girl and produce her before the Court on March 11 2016.
