A 29-year-old man, who suffered disability in a road accident involving a rashly driven DTC bus in 2013, has been awarded a compensation of over Rs 26 lakh by a Motor Accident Claims Tribunal (MACT) here.
The tribunal directed United India Insurance Company Ltd, with which the offending bus was insured, to pay Rs 26,83,836 as compensation to Bihar resident Niraj Nandan, who was injured in the road accident.
"In the light of the law and after going through all the documents i.E. Copy of FIR, MLC of the injured, site plan, seizure memo of DL and verification, seizure memo of RC...As well as documents filed by the petitioner as a whole it is clear that respondent no 2 (driver) was driving the vehicle in rash and negligent manner," MACT Presiding Officer R P S Teji said.
According to the petition filed by Nandan, the accident took place on March 21, 2013 when he was sitting on the pillion of a motorcycle. As he reached in front of metro pillar no 614, Shanker Garden, Main Vikas Puri crossing here, the offending bus, driven in a rash and negligent fashion, hit his vehicle.
Due to the impact, he fell down and sustained grievous injuries which caused 70 per cent disability in his right lower limb, it said.
It that he was employed in a private firm and was earning Rs 16,682 per month. He had approached the tribunal claiming a compensation of Rs 80 lakh.
The driver, in his written submission, denied the rash and negligent aspect and also termed the contents of the petition as false.
The tribunal, however, relied on the testimony of Nandan and the doctor, who said that he had sustained grievous injuries.
